IWPA Applauds U.S. District Court for Signing Order in Sierra Club-EPA Formaldehyde Litigation

Alexandria, Virginia – The International Wood Products Association (IWPA) applauded the U.S. District Court for the Northern District of California/Oakland Division for issuing its order that provides orderly resolution of the Court’s decision vacating a one-year delay of the formaldehyde emission standard for composite wood products in a suit filed by Sierra Club and a Community Voice—Louisiana against the Environmental Protection Agency (EPA).

 

The following statement is from IWPA Executive Director Cindy Squires:

 

“IWPA applauds the court for issuing its order that ensures industry can implement the Court’s decision without significant supply disruptions or adverse impacts on the many small- to medium-sized businesses in the supply chain.  IWPA was pleased to work closely with all stake holders to develop a joint stipulation filed with the Court on Friday, March 9, 2018.  Wood products industry stakeholders worked closely together to forge a feasible agreement for the whole supply chain that was also reasonable for all parties involved in the case.  The agreement allows for the new compliance date of June 1st to be prospective, and with enough time to allow product in inventory and in transit to be unaffected.  Under the reciprocity provisions, companies can continue to import CARB Phase 2 compliant products until March 22, 2019 when the transition to TSCA VI products will be complete.  We look forward to continuing to work with the Environmental Protection Agency on implementation in the coming months now that this litigation is behind us.”
